Terms of Service & End User License Agreement

1. Acceptance of Terms

By downloading, installing, or using this application (“App”), you agree to be bound by these Terms of Service and End User License Agreement (“Agreement”). If you do not agree to these terms, do not use the App.

This App provides item identification services by analyzing photographs of specific items using artificial intelligence technology in conjunction with select third-party websites. The App is designed solely for the identification and informational purposes related to legitimate items.

3. Permitted Use

You agree to use the App only for its intended purpose of identifying legitimate items through photograph analysis. You may not use the App for any purpose other than those explicitly described in the App’s documentation.

4. Prohibited Uses

You expressly agree NOT to use the App for:

• Identifying, analyzing, or processing any illegal, obscene, pornographic, or sexually explicit material
• Identifying or processing images of minors in any inappropriate context
• Any unlawful, harmful, threatening, abusive, or objectionable purposes
• Circumventing, violating, or encouraging the violation of any local, state, national, or international law
• Identifying items for illegal trade, trafficking, or criminal activity
• Stalking, harassment, or invasion of privacy
• Any fraudulent or deceptive purposes
• Creating, distributing, or promoting illegal, illicit, or perverse content

Any violation of these prohibited uses will result in immediate termination of your license to use the App and may be reported to appropriate authorities.

5. Valuation Disclaimer

IMPORTANT: Any estimated values, prices, or appraisals provided by the App are for informational and estimation purposes only.

You acknowledge and agree that:

• Value estimates are approximations based on available data and algorithms
• No guarantee, warranty, or representation is made regarding the accuracy, completeness, or reliability of any valuation
• Actual values may vary significantly based on condition, market fluctuations, location, authenticity, and numerous other factors
• The App does not provide professional appraisal services
• You should not rely solely on App-provided valuations for financial, legal, or commercial decisions
• We recommend consulting with qualified professional appraisers for official valuations
• No written or implied warranty exists regarding the accuracy of any estimated value

The App does not provide professional appraisal, legal, financial, or expert advice. Information provided is for general informational purposes only and should not be relied upon for professional decisions.

The App utilizes select third-party websites for identification purposes. We are not responsible for the content, accuracy, policies, or practices of these third-party sites. Your use of third-party websites is subject to their respective terms and conditions.

8. Intellectual Property

The App and all associated intellectual property rights remain the exclusive property of the App developer. This license does not grant you any ownership rights to the App.

9. Privacy and Data

By using the App, you consent to the collection and processing of photographs and data as described in our Privacy Policy. Images processed by the App may be transmitted to third-party services for identification purposes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

11. Warranty Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. No Obligation to Maintain, Support, or Update

The developer does not guarantee that the App will be maintained, supported, updated, upgraded, or enhanced. The developer may, at its sole discretion, modify, suspend, discontinue, or restrict access to any part of the App at any time, with or without notice. You acknowledge that the developer has no obligation to provide maintenance, technical support, updates, bug fixes, patches, or new versions of the App.

13. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms.

14. Monitoring and Enforcement

We reserve the right to monitor use of the App and to take appropriate action, including reporting to law enforcement, if we detect violations of these Terms or illegal activity.
